Immigration Law - Immigration Knowledge

This is the category most frequently used by businessmen coming to the U.S. to conduct business. This Category requires a B-1 visa.

Secretary of State Many visitors can enter the U.S. as a visitor without a visa.  Known as the Visa Waiver Program (VWP) the details are too lengthy for this article.  Please click on our VISA WAIVER link or the Secretary of State's photo for all the details.

Business is not Work

If you are a visitor for business it is important not to inadvertently imply that you will be working in the U.S.  To the immigration or consular officer "work" is a term of art meaning 'performing labor' with or without compensation.  If your reason for coming to the U.S. is to work then you need to be looking at one of the work authorized categories such as H. L, O, or P, R.

 If Business is not performing labor then what is it? 

The U.S. Foreign Affairs Manual sates that qualified activities include coming to "Engage in Commercial Transactions, Negotiations, Consultations, Conferences, etc."  This but a short list if you are unsure of the proper visa category then contact Mr. Feldman to arrange a consultation. 

The Law INA § 101(a)(15) (B) - an alien (other than one coming for the purpose of study or of performing skilled or unskilled labor or as a representative of foreign press, radio, film, or other foreign information media coming to engage in such vocation) having a residence in a foreign country which he has no intention of abandoning and who is visiting the United States temporarily for business or temporarily for pleasure;

 The Regulations 8 CFR § 214.2(b)(B) - an alien (other than one coming for the purpose of study or of performing skilled or unskilled labor or as a representative of foreign press, radio, film, or other foreign information media coming to engage in such vocation) having a residence in a foreign country which he has no intention of abandoning and who is visiting the United States temporarily for business or temporarily for pleasure.
